I mean say we do bid 5 spades and it comes back around to us at 6H what then?

Edit: I do think there is such a thing as 4S and 5S but I don't like overdoing it.

I do. This is not a case where you should consider 5S first round, even with a bit more distribution, IMO.

It may be worse if they can then bid slam which they have not done so far (just a thought since we have no reason to assume we can beat 7h)

What sort of tweaks to the hand would tempt you?

Even tho partner is a passed hand, there is no reason to assume that they can bid a slam over 4♠ or, and this is fairly important, that they can make anything they do bid, whether it be at the 5 level or higher. Partner is allowed to be very short in spades and to hold enough nuisance stuff that they are doomed if they bid.
That isn't to say that I can't see bidding 5♠ if they bid over 4♠. However, I would need a much better playing hand than this one. KQJ10xxxxx void QJxx void is certainly a hand on which I would bid again, as a perhaps over-the-top example.

Maybe I formulated this badly. I am not sure there is a hand that would tempt me to bid 5♠ right away - it would have to be very extreme. But there are hands where I would be tempted to bid 5♠ if they compete over 4♠.
To modify Mike's example just a little bit - if you had KQJTxxxx - QJTx x then it seems right to compete over 5♥ or 5♣. But it's almost 50% that LHO has a doubleton spade, in which case you are quite likely to buy it in 4♠ (maybe doubled). You might also buy it there when he has a singleton, as he'll typically double rather than bid with 1444 or 1534 or 0544 and opener will usually pass.
