I assume there was no alert in which case it's natural.
I pause an appropriate amount of time to allow north to wake up with a late alert but don't think it's my job to ask and avoid a mixup by them, ie. if it was a splinter but north obviously doesn't think so by the failure to alert.
If it's just a straight up failure to alert we are entitled to protection but not if no damage occurs as would be the case if we both own passes throughout and the 4♥ bidder warns us before the opening lead. In short if it doesn't affect our bidding or defence.
